1. Acceptance of Terms

By accessing or using the Luluclass website and application (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service. We reserve the right to update these Terms at any time; continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

Luluclass is an online platform that connects students with independent language teachers for one-on-one lessons. Luluclass acts as an intermediary marketplace and is not itself a language school or teaching provider. Teachers on the platform are independent contractors, not employees of Luluclass.

3. Accounts

To use the Service you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept responsibility for all activity under your account
• Notify us immediately at hello@luluclass.com of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or abusively.

4. Student Terms

Booking lessons: Students may browse teacher profiles and book lessons based on teacher availability. A booking is confirmed once payment is processed successfully.

$1 first lesson guarantee: Eligible new students may access their first lesson for $1. This offer is limited to one per person and may not be combined with other promotions. Luluclass reserves the right to modify or discontinue this offer at any time.

Satisfaction guarantee: If you are not satisfied with a lesson, please contact us within 24 hours of the lesson's scheduled end time. Refunds or credits are issued at our discretion on a case-by-case basis.

Cancellations and rescheduling: Students may cancel or request to reschedule a lesson in accordance with the cancellation policy displayed at the time of booking. Late cancellations or no-shows may not be eligible for a refund.

5. Teacher Terms

Independent contractor status: Teachers use Luluclass as a marketplace to offer their services. Teachers are solely responsible for the content and quality of their lessons, their tax obligations, and compliance with applicable laws.

Profile accuracy: Teachers must ensure their profile, qualifications, availability, and pricing are accurate and kept up to date.

Conduct: Teachers must treat all students with respect and professionalism. Luluclass reserves the right to remove any teacher from the platform for conduct that violates these Terms or reflects poorly on the platform.

Payouts: Teacher earnings are paid out according to the payout schedule and terms communicated within the platform. Luluclass deducts a platform commission from each lesson payment. The current commission rate is displayed in your teacher dashboard.

6. Payments

All payments are processed securely by Stripe. By making a payment, you also agree to Stripe's Terms of Service. Luluclass does not store your full payment card details.

All prices are displayed in USD unless otherwise stated. You are responsible for any applicable taxes or currency conversion fees charged by your bank or card provider.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Harass, abuse, threaten, or discriminate against other users
• Post false, misleading, or defamatory content
• Attempt to circumvent the platform by arranging payments with teachers outside of Luluclass
• Scrape, copy, or distribute any content from the Service without permission
• Introduce malware, viruses, or any other harmful code
• Impersonate any person or entity

8. Intellectual Property

All content on the Luluclass platform — including the logo, design, software, and text — is the property of Luluclass or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

By submitting content to the Service (such as profile photos, lesson materials, or messages), you grant Luluclass a non-exclusive, royalty-free licence to use, display, and store that content as necessary to operate the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Luluclass does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Luluclass does not endorse or verify the qualifications, credentials, or background of teachers on the platform. Students are responsible for evaluating teachers before booking.

10. Limitation of Liability

To the maximum extent permitted by law, Luluclass shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or loss of goodwill.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to Luluclass in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including intellectual property, disclaimers, and limitation of liability.
